Terms of Service

Welcome to Bibsy

These Terms of Service ("Terms") govern your use of the Bibsy app and website (collectively, the "Service"), operated by Bibsy ("we", "us", "our").

By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

Account eligibility

You must be at least 13 years old, or the digital age of consent in your jurisdiction (whichever is greater), to create a Bibsy account. By creating an account you confirm you meet this requirement.

Bibsy is designed for parents and caregivers logging information about their own babies. You may not use Bibsy to log information about children for whom you are not the parent, legal guardian, or authorised caregiver.

Your account

You are responsible for:

• Keeping your password confidential
• All activity that occurs under your account
• Notifying us promptly if you suspect unauthorised access (security@bibsy.app)
• Providing accurate information when creating and maintaining your account

You may have one account. Household sharing (where multiple caregivers track the same baby) is supported via the in-app partner invite feature — each caregiver should have their own login.

Your data

You retain ownership of all data you enter into Bibsy, including baby logs, photos, notes, and growth measurements ("Your Content").

By using the Service, you grant us a limited, non-exclusive licence to host, process, and display Your Content solely for the purpose of providing the Service to you and the household members you've invited. This licence ends when you delete the content or your account.

We do not:

• Sell Your Content
• Use Your Content for advertising
• Use Your Content to train AI models
• Share Your Content with third parties except as described in our Privacy Policy

You can export or delete Your Content at any time. Account deletion is available via Settings → Account → Delete Account.

Acceptable use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to reverse-engineer, decompile, disassemble, or extract source code from the Service except as expressly permitted by law
• Use automated scripts, bots, or scrapers to access the Service except via published APIs and within reasonable rate limits
• Upload content that violates someone else's rights, contains malware, or includes unlawful material
• Impersonate another person or misrepresent your affiliation with any person or entity
• Use the Service to harass, threaten, abuse, or harm anyone, including other household members
• Attempt to gain unauthorised access to any account, data, or system component
• Interfere with or disrupt the integrity or performance of the Service

We may suspend or terminate accounts that violate these rules.

Service availability

We aim for high availability but cannot guarantee uninterrupted service. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including (but not limited to) implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We may modify, suspend, or discontinue features at any time, with or without notice. We'll do our best to give advance notice for material changes that affect your data.

Payments and subscriptions

Bibsy is currently free to use. If we introduce paid features in the future:

• Pricing will be clearly disclosed before you pay
• You'll always have the option to keep using the free tier or upgrade
• Subscriptions auto-renew unless cancelled, per the rules of the platform you subscribed through (App Store, Play Store, or direct)
• Refund policy will follow the respective platform's rules

Limitation of liability

To the maximum extent permitted by applicable law, Bibsy and its operators are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of data, loss of profit, loss of goodwill, or other intangible losses — arising from or related to your use of the Service, even if we've been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising from or related to the Service is limited to the greater of (a) the amount you have paid us in the twelve months preceding the claim or (b) fifty US dollars (USD $50).

This limitation does not apply to gross negligence, willful misconduct, or rights that cannot be limited under applicable consumer-protection law. Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above may not apply to you.

Indemnification

You agree to indemnify and hold Bibsy harmless from any claim, demand, loss, or expense (including reasonable attorney fees) arising from your use of the Service in violation of these Terms, your violation of any law, or your violation of any third-party rights.

Termination

You can terminate your account at any time via Settings → Account → Delete Account in the app. You'll be asked to type a confirmation phrase to prevent accidents. Termination is permanent — all your data is removed within 30 days of confirmation.

We may terminate or suspend your account if you materially violate these Terms, if required by law, or for other legitimate operational reasons. We'll notify you when reasonably possible.

Changes to these Terms

We may update these Terms as Bibsy evolves. Material changes will be announced via email and an in-app notice. The "Last updated" date at the top of this page reflects the current version.

Continued use of the Service after a change indicates acceptance of the updated Terms. If you don't agree, you can delete your account before the change takes effect.

Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which Bibsy is operated, without regard to conflict-of-laws principles. Mandatory consumer-protection laws applicable to you continue to apply regardless of this choice of law.

Disputes arising from or related to these Terms or the Service should first be raised with us via support@bibsy.app. We'll work in good faith to resolve issues informally.

If informal resolution is not possible, disputes will be resolved in accordance with the dispute-resolution mechanisms available in your jurisdiction, including any mandatory consumer arbitration rights.
